Another win for LVMH legal team

LVMH added another important counterfeit case win to its tally when a French court ruled on Monday that ebay has to pay €1.7m (A$2.84m) in damages for failing to stop the sales of LVMH perfume and beauty products on its French website, in breach of a court order handed down in 2008.

This case was a continuation of the larger case which resulted in eBay having to pay €40m (A$64.2m) in damages for not doing enough to halt the sale of counterfeit LVMH products on the site (namely Dior and Louis Vuitton).

The injunction prevented any LVMH goods being sold on eBay, whether authentic or counterfeit, but more than 1,000 products had been listed on the French site since the injunction was issued in 2008, which in eBay terms is probably a slip through the net but it clearly shows the software filters installed to capture any LVMH branded goods are not working.
